1. Who is NovaCair and how can I contact NovaCair?

2. Access to the website

Access to the website and its use is strictly personal. As a Visitor and/or User, you shall not use this website or the data and information provided on it for commercial, political, or advertising purposes, nor for any commercial offers, and in particular not for unsolicited electronic communications.

NovaCair collects two types of data regarding its Visitors and Users:

  1. Unidentified and non-identifiable information pertaining to a Visitor or an unauthenticated User, which we have obtained or automatically collected through their use of the Services ("Non-Personal Data"). Non-Personal Data does not allow us to identify the specific Visitor or User to whom it relates. The Non-Personal Data we collect primarily consists of technical information and aggregated usage data, such as browsing behavior and "click-stream" activity of Visitors and Users on the Services, session heatmaps, scroll information, and non-identifying information regarding devices, operating systems, web browsers, screen resolutions, language, and keyboard settings.
  2. Individually identifiable information, meaning information that identifies an individual or from which an individual's identity can be reasonably deduced, or information of a potentially personal or sensitive nature ("Personal Data"). The Personal Data we collect primarily consists of contact information (such as email address or phone number), billing details (such as name, physical billing address, payment method, and transaction details, collected exclusively from Users of Paid Services), browser or usage session data (IP address, geographic location, and/or unique device identifier), correspondence (including communications sent or uploaded via our Services), and any other Personal Data provided by Visitors and/or Users while utilizing our Services. For the avoidance of doubt, Non-Personal Data that is linked to Personal Data (for example, to improve our Services) will be treated and considered by us as Personal Data for as long as such linkage persists.

NovaCair only collects personal data if you use our services and/or because you provide this data to NovaCair yourself.

7. Processing of Personal Data

Novacair processes various types of personal data for different purposes. Article 6 specified which personal data is collected. Article 7 outlines the purposes for which this personal data is processed.

We process Non-Personal Data and Personal Data for the following purposes:

  1. To provide and operate the services;
  2. To further develop, customize, and improve our services based on the collective or personal preferences, experiences, and/or issues of Visitors and Users;
  3. To provide our Users with customer and technical support;
  4. To contact our Visitors and Users with general or personalized notices regarding our services;
  5. To enhance our data security and fraud prevention features;
  6. To comply with all applicable laws and regulations.

We will only use your Personal Data for the purposes described in Article 7 above if we are satisfied that:

  • the use of your Personal Data is necessary to perform a contract or take steps to enter into a contract with you (for instance, to provide you with customer or technical support), or
  • the use of your Personal Data is necessary to comply with a legal obligation to which we are subject, or

Our Services are not intended for children under the age of 16. No one under 16 should provide Personal Data to us through any of our Services. We do not knowingly collect Personal Data from children under 16. Parents and guardians should always supervise their children's online activities.

Provision of Services

To guarantee optimal service delivery, NovaCair utilizes various types of personal data. This may include your name, address, phone number, email, and other potential personal data, as well as sensitive personal data such as physical condition and medication use. Without this personal data, NovaCair is unable to provide these services.

Third Parties

NovaCair engages external companies, subcontractors, and/or suppliers (so-called data processors) who perform specific tasks or assignments on behalf of NovaCair, with whom your personal data may be shared. These service providers process your personal data exclusively on behalf of NovaCair. Processing by certain service providers is governed by a data processing agreement, in which NovaCair has ensured that the service provider will process personal data solely according to NovaCair's instructions.

Some examples of processors include:

  • external hosting providers, including cloud providers for the storage and management of your data;
  • external parties to whom specific tasks have been outsourced, including IT support, email marketing, and facility management;
  • external advisors and/or consultants.

Additionally, NovaCair may provide your personal data to external parties, such as the police and government authorities, if NovaCair is entitled or required to do so pursuant to applicable laws and/or regulations, by means of a court order or judicial ruling, or if you have given your consent.

If certain information is necessary to access specific functionalities of the website, the controller will indicate the mandatory nature of this information at the time the data is requested.

8. Your rights regarding your data

Pursuant to Article 13(2)(b) of the GDPR, every data subject has the right to access, rectify, or erase their personal data, or to restrict the processing concerning them, as well as the right to object to processing and the right to data portability. Any such request must be accompanied by a copy of a valid ID, bearing your signature and stating the address at which you can be contacted. You will receive a response to your request within 1 month of submission. Depending on the complexity and number of requests, this period may be extended by up to 2 months if necessary.

9. Data retention period

The data collected by the website administrator is used and stored for the duration determined by law.

10. Cookies

Cookies are small pieces of (text) information that are sent to your browser when you visit the website and are subsequently stored on the hard drive or in the memory of your computer, tablet, and/or mobile phone (hereinafter: "Device"). Your browser can send this information back to the website on a subsequent visit. The cookies placed via the website cannot damage your Device or the files stored on it.

NovaCair cookies

NovaCair uses technical and functional cookies, which are necessary to provide the website in a user-friendly manner or to obtain information about the quality or effectiveness of the website. For example, functional cookies ensure that you do not have to log in again on every page after logging into the website, and they remember your entered settings, such as your language preferences.

Important: NovaCair does not use cookies in its own web application(s).

Third-party cookies

In addition to the cookies placed by NovaCair itself, third-party cookies are also placed on your Device via the website. This section applies to these so-called third-party cookies.

Google Analytics

To collect web statistics regarding the use and visits to the website, NovaCair uses Google Analytics. Google Analytics places a permanent cookie on your device through which website usage is registered. This data is then analyzed by Google and the results are provided to NovaCair. This gives NovaCair insight into traffic to and from the website and how the website is used. Based on this data, NovaCair can implement adjustments to the website or its services if necessary. The data obtained in this manner is transferred to Google and stored by Google on servers in the United States.

NovaCair has implemented the following measures to protect your privacy:

  • NovaCair has concluded a data processing agreement with Google containing arrangements regarding the handling of collected data. In this agreement, NovaCair has prohibited Google from using the obtained information for other Google services.
  • NovaCair has removed the final octet of your IP address. IP addresses consist of 4 so-called octets of 3 digits each. Google offers the option to remove the final octet of website visitors' IP addresses. This takes place in temporary memory, even before the IP address is stored by Google.
  • NovaCair has disabled data sharing settings with Google within Google Analytics, preventing Google from using the data for its own (advertising) purposes.
  • NovaCair does not use Google Analytics in combination with other Google services.

HubSpot

NovaCair uses HubSpot for contact forms on the website, email campaigns, and customer relationship management (CRM). HubSpot places cookies on your device to recognize visitors, store form submissions, measure the effectiveness of our communication, and improve user experience. These cookies can track how you use the website and whether you open or respond to marketing emails from NovaCair.

NovaCair has configured HubSpot to collect only the minimum necessary data. Any personal data processed via HubSpot is processed solely on behalf of NovaCair.

WordPress

Novacair uses the WordPress platform to host its website. WordPress uses cookies to monitor and analyze the performance, functionality, and effectiveness of the WordPress platform, as well as to ensure the platform is secure to use. These terms and conditions are governed by Dutch law. The court of the administrator's registered office shall have exclusive jurisdiction in the event of any disputes concerning these terms and conditions, except where a statutory exception applies.
